Congress is making it difficult to close Guantanamo. Please note: President Obama is not in Congress.
In order to buy time, the Obama Administration may issue an executive order so that they can later RESCIND it once the prison is closed. It’s mentioned in the article:
“”Civil liberties groups have encouraged the administration, that if a prolonged detention system were to be sought, to do it through executive order,” the official said. Such an order could be rescinded and would not block later efforts to write legislation, but civil liberties groups generally oppose long-term detention, arguing that detainees should be prosecuted or released.”
Guantanamo houses people without charge (in fact, several people released to Palau a few weeks ago were completely innocent, and had never been charged or suspected of anything). In order to keep it open legally for the amount of time needed to convince Congress to close it, the Administration realizes the need for an EO. Notice, however, that they aren’t trying to legislate long-term detention; that would be “wearing the Bush clothes,” but luckily those in the Obama Administration are not dumb enough to do that.
